1. BINDING AGREEMENT & COMPANY OPERATIONAL SCOPE

This website, Peptide Cases (referred to herein as "the Site", "Peptide Cases", or "the Store"), is owned and operated by Peak Mens Health Pty Ltd (referred to herein as "the Company," "we," "us," or "our"). By visiting our Site, accessing our digital layout, and/or purchasing physical items from us, you engage in our "Service" and agree to be bound by the following terms, conditions, and operational disclaimers (“Terms of Service”, “Terms”).

The Company operates exclusively as a commercial developer and retail supplier of universal, passive physical storage cases, utility organizers, and mechanical pill-cutting tools (collectively referred to as "Physical Hardware"). Peak Mens Health Pty Ltd, trading as Peptide Cases, does not supply, distribute, compound, formulate, import, prescribe, license, or promote any therapeutic goods, pharmaceutical substances, prescription medicines, or unapproved biological or chemical materials.

2. ABSOLUTE REGULATORY DISCLAIMER & EXCLUSION OF INTENDED USE

  • Compliance with the Therapeutic Goods Act 1989 (Cth): All Physical Hardware items displayed on this Site are non-therapeutic consumer goods. They do not constitute, contain, or incorporate therapeutic goods or medical devices as defined under the Therapeutic Goods Act 1989 (Cth). 3. WAIVER OF STERILITY & MAINTENANCE SPECIFICATIONS

  • No Medical-Grade Sterilization Claims: While our high-performance Hardware configurations feature protective structural benefits, including heavy-duty impact shells, advanced silicone sealing rings, and specialized airtight barriers, they are not sold or represented as medical-grade clinical sterilizers, sterile containment fields, or active laboratory units.

  • User Contamination Protocols: Maintaining the sterile field, required structural vacuum, or hygienic integrity of any third-party medical vial, plunger, needle, or device housed inside our Hardware is exclusively the operational responsibility of the user and their qualified medical practitioner. The Company explicitly disclaims all civil liability for any biological degradation, structural contamination, material spoilage, or chemical breakdown of items placed within the Hardware.

4. ORDER VERIFICATION, ACCOUNT SCREENING, & RIGHT TO REFUSE SERVICE

  • Prohibited Communications & Account Erasure: The Company maintains a zero-tolerance policy for any interactions that risk misaligning our Hardware brand with the unlawful marketing or administration of unapproved therapeutic goods. We reserve the absolute right—at our sole and unrestricted discretion—to cancel any pending order, refuse supply, terminate any user account, freeze digital checkout paths, and permanently block customers without liability if a buyer’s communications, support tickets, product reviews, or order notes:

    1. Expressly imply or suggest an intent to use our Physical Hardware in violation of Australian state or federal pharmaceutical or customs regulations;

    2. Attempt to solicit medical instructions, chemical mixing directions, or compound efficacy reviews from our staff;

    3. Misrepresent the non-therapeutic, mechanical purpose of our storage cases.

5. REVENUE AND SITE FINALITY (ANTI-COMPLIANCE INTERRUPTION CLAUSE)

  • Payment & Fraud Shielding: We utilize secure, PCI-compliant third-party financial aggregators and payment processors. If a payment processor flag, automated compliance sweep, or risk assessment tool triggers an account freeze or transactional hold based on a buyer's profile, we reserve the right to withhold shipment pending formal clearance or cancel the order entirely.

  • Order Finality: All orders are considered commercially final once payment has been securely authorized. Cancellations or changes to shipping data are not permitted once fulfillment logistics are initiated.

6. INDEMNIFICATION & REGULATORY ENFORCEMENT PROTECTION

You agree to indemnify, defend, and hold completely harmless the Company, its directors, parent entities, subsidiaries, logistics partners, and agents from any and all civil claims, losses, structural damages, financial liabilities, administrative costs, or legal expenses (including full solicitor-client legal fees) arising directly or indirectly out of:

  • Your physical handling, transport, deployment, or modification of any Physical Hardware item purchased from us;

  • Your choice of contents stored within the Physical Hardware;

  • Any regulatory inquiry, Therapeutic Goods Administration (TGA) audit, state health department investigation, Australian Border Force (ABF) border intervention, or product seizure triggered by your personal use, independent possession, or illegal redistribution of scheduled or unapproved compounds within our Physical Hardware.

7. FORCE MAJEURE & COMPLIANCE DISRUPTIONS

The Company is completely absolved of liability for any supply chain failures, transit delays, or performance omissions resulting from circumstances beyond our reasonable control. This includes, without limitation: acts of God, global pandemics, severe weather disruptions, carrier strikes, infrastructure outages, payment gateway policy terminations, automated merchant processor freezes, regulatory interdictions, or seizures executed by any state or federal authority.

8. GOVERNING LAW & JURISDICTIONal VENUE

These Terms of Service, along with your commercial acquisition of our Physical Hardware, shall be governed by, executed under, and construed in strict accordance with the laws of the national laws of Australia. The courts of Western Australia and the Federal Court of Australia shall hold exclusive jurisdictional venue to settle any dispute or claim arising out of or relating to these Terms or storefront transactions.

9. SEVERABILITY & INTEGRATION OF THE ENTIRE AGREEMENT

If any distinct covenant, clause, or specific provision of these Terms of Service is determined by an Australian court of competent jurisdiction to be invalid, illegal, or completely unenforceable under current statutory frameworks, that provision shall be limited or severed only to the minimum extent necessary. The remaining provisions of these Terms shall continue in full, unrestricted force and legal effect, constituting the absolute, integrated commercial agreement between you and the Company.

10. Product Disclaimer & Regulatory Notice

Peptide Cases is owned and operated by Peak Mens Health Pty Ltd. All products offered on this website are sold exclusively as empty, passive physical storage hardware, utility organizers, and mechanical cutting tools ("Physical Hardware").

Important Regulatory Notice: This Site does not sell, distribute, promote, or advertise any therapeutic goods, prescription medications, peptides, hormones, or unapproved chemical substances. Any reference to structural terms such as "vials," "auto-injector pens," or "compartments" is strictly descriptive of the physical dimensions and mechanical storage capacity of our cases.

Maintaining the required sterility, temperature control, and legal compliance of any personal contents or prescribed medications remains solely the responsibility of the user. We reserve the right to refuse service or cancel orders if customer communications suggest an intent to use our hardware in violation of Australian federal or state regulations.
